1. Acceptance of Terms

By accessing and using Voctra.AI's services ("Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

2. Description of Service

Voctra.AI provides AI-powered call management services including but not limited to:

  • Automated call answering and routing
  • Call recording and transcription services
  • AI-powered call analysis and insights
  • SMS and notification services
  • Customer relationship management tools
  • Analytics and reporting features

3. SMS and Text Messaging Terms

SMS Service Agreement

Voctra AI offers optional SMS messaging services for appointment reminders and notifications. The following terms apply to our SMS messaging services:

Optional Service

SMS messaging is entirely optional. You are not required to opt in to SMS messaging as a condition to use Voctra AI services. You may choose to receive notifications through other methods such as email or in-app notifications.

Types of Messages

If you choose to opt in, you may receive the following types of messages:

  • Appointment confirmations and reminders
  • Updates regarding scheduled appointments
  • Service notifications related to your account

Consent and Opt-In

Your explicit consent is required before any SMS messages are sent. This consent is provided through a checkbox with the statement: "I agree to receive appointment reminders via SMS from Voctra AI. Message and data rates may apply. Message frequency varies. Reply STOP to unsubscribe."

You may provide this consent during the onboarding process or at any time afterward through your account settings.

Opt-Out Instructions

You may opt-out of SMS messages at any time by:

  • Replying "STOP" to any message you receive from us
  • Updating your notification preferences in your account settings
  • Contacting our support team

After opting out, you will no longer receive SMS messages from our platform.

Message and Data Rates

Message and data rates may apply to SMS messages sent through our platform. Standard messaging rates from your wireless carrier will apply.

4. User Accounts and Registration

To access certain features of the Service, you must register for an account. You agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain and promptly update your account information
  • Maintain the security and confidentiality of your login credentials
  • Accept responsibility for all activities under your account
  • Notify us immediately of any unauthorized use of your account

5. Acceptable Use Policy

You agree not to use the Service to:

  • Violate any applicable laws or regulations
  • Infringe on intellectual property rights
  • Transmit harmful, offensive, or inappropriate content
  • Engage in spam, phishing, or other malicious activities
  • Attempt to gain unauthorized access to our systems
  • Interfere with or disrupt the Service
  • Use the Service for illegal telemarketing or robocalling

6. Call Recording and Privacy

Our Service includes call recording capabilities. By using the Service, you acknowledge and agree that:

  • You are responsible for complying with applicable call recording laws
  • You must obtain proper consent from call participants where required
  • You will inform callers about recording when legally required
  • Call recordings are processed by our AI systems for transcription and analysis
  • We implement security measures to protect recorded content

7. Payment Terms

If you purchase a paid subscription:

  • Fees are charged in advance on a recurring basis
  • All fees are non-refundable unless otherwise stated
  • You authorize us to charge your payment method
  • Prices may change with 30 days' notice
  • Accounts may be suspended for non-payment

8. Intellectual Property

The Service and its original content, features, and functionality are owned by Voctra.AI and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

9. Data Ownership and Usage

  • Your Data: You retain ownership of your business data and call content
  • Service Data: We may use aggregated, anonymized data to improve our services
  • AI Training: Call data may be used to train and improve our AI models
  • Data Portability: You can export your data upon request

10. Service Availability

While we strive for high availability, we do not guarantee uninterrupted service. We may:

  • Perform scheduled maintenance with notice
  • Experience temporary outages due to technical issues
  • Modify or discontinue features with reasonable notice
  • Suspend service for violations of these terms

11. Limitation of Liability

To the maximum extent permitted by law, Voctra.AI shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses.

12. Indemnification

You agree to defend, indemnify, and hold harmless Voctra.AI from and against any claims, damages, obligations, losses, liabilities, costs, or debt arising from your use of the Service or violation of these Terms.

13. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions.

15. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by email or through the Service. Your continued use after such notice constitutes acceptance of the new Terms.

16. Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
